Order confirmation. This confirmation may, however, be made by other means and/or Services external to this Service. The User is responsible for paying for the telephone calls made and any other telecommunications costs for the use of the Service to the operators from which the communications originated.

Basic access to the Service does not require prior registration of the User. However, in order to have access to some additional features, namely the purchase of products and services, as well as more personalized information, the User will have to register.

You will be solely responsible for your registration data, including your username, e-mail address and password to access the Service. A Bem Vinhoswill not be liable for any damages or losses suffered by the User or third parties as a result of the use of their registration data, with or without their knowledge. The registered User shall keep his/her registration data confidential, avoiding its use by third parties.

F - Access to information

The entities providing the Service may have access to the content of the messages sent and/or received by the user, with the consent of the user, by virtue of the law or judicial decision or when, for reasons of force majeure, access is necessary.

G - Use of Users' data

For all legal purposes of personal data protection and database management, the User considers himself a customer of Bem Vinhosfrom the moment he registers in this Service, even if no economic transaction is carried out. By registering, the User authorizes Bem Vinhos, which manages the service, to use the personal data then provided, as well as to use the information arising from the consultations and transactions that it makes for automatic administrative and statistical processing, for the future presentation of its products and services, under the terms that may be defined by the National Commission for Data Protection. The user is always guaranteed access to their data, its rectification or deletion under the terms of Law 67/1998, of 26 October and Law 69/1998, of 28 October. Bem Vinhos, through its legal representatives, will be responsible for the personal data provided through this Service, or others associated with it, registered in its database. The User must also take into account that he is sending his data over open networks, namely the Internet.

H - Prices

All values shall be considered as indicative only and are subject to confirmation and/or change without notice.

The base currency for all transactions will be the euro. Any values expressed in other currencies are indicative only and may not correspond to the prevailing exchange rate.

Unless otherwise indicated, all values include VAT at the legal rate in force. To the amounts presented may be added expenses of preparation, transportation and / or associated with the method of payment, which will be calculated and confirmed during the process of finalization of the order. In case of doubt about the final total amount to be paid, the User must previously contact the services of Bem Vinhos.

I Cancellations, Exchanges and Returns

The User may cancel his/her order at any time until the actual dispatch of the products and/or provision of the services ordered.

Any order will only become effective after confirmation of your payment.

À Bem Vinhos, pursuant to Decree-Law no. 7/2004 of 7 January (as amended by Decree-Law no. 62/2009 of 10 March and Law no. 46/2012 of 29 August), reserves the right to unilaterally cancel the order whenever there are computer, data entry or other errorswhich call into question their contract.

The delivery of products purchased through this Service will fully respect the rules applicable in Portugal to the various branches of distance commerce, namely Decree-Law no. 24/2014 of 14 February (with the amendments conferred by Decree-Law no. 47/2014 of 28 July), which includes a period of 14 days during which the Customer / User can proceed to the termination of the contract without the need to indicate any reason. This period will be counted from the moment when the consumer, or a third party indicated by him other than our carrier, acquires physical possession of all the goods ordered or, in the case of the purchase of services, from the day on which the contract was concluded. À Bem Vinhosreserves the right to only accept the return of products that are presented in their original packaging and without any evidence of use. The Customer/User will be responsible for all possible logistical expenses inherent in the process of delivery and return of said products.

Except for manufacturing anomalies, returns/exchanges of items that have been produced according to customer specifications or undergone any type of customization, items that for hygiene reasons are not suitable for return or whenever the return period previously indicated has already been exceeded will not be accepted.

Any return process must be previously communicated by the Customer / User and authorized by our services.

In case of effective return, the refund of the amount will only be made after the validation of the return conditions described above and, after receipt of the goods in our facilities, it will be carried out within a maximum period of 14 days.

J - Warranties

Notwithstanding legal provision to the contrary, in accordance with the provisions of Decree-Law no. 67/2003, of 8 April, as amended by Decree-Law no. 84/2008, of 21 May, and other legislation in force, all products supplied and services provided by Bem Vinhosare covered by a guarantee at the time of their supply / provision. Consumable or fast-wear products (i.e. cartridges, toners, batteries, batteries, etc.) may have shorter warranty periods than usual for other equipment. The Customer / User should also take into account that the current law assigns a minimum warranty period of 2 years for end users (non-profit) and 6 months for companies (and other for-profit customers), prevailing for the allocation of this period the data contained in the invoice, or other document that replaces it, issued at the time of purchase, as well as their respective date. In general, the warranty terms cover any malfunctions caused by manufacturing defects and/or others attributable directly to the manufacturer, not covering the improper use of the equipment, software misconfigurations, natural wear and tear or other situations attributable to the Customer/User. In cases where the warranty terms do not apply, the Customer / User will be notified of this situation and the respective reasons, proceeding to the budgeting of the repair whenever it is possible. Unless otherwise stated, the Customer / User will be responsible for all possible logistical expenses inherent in the process of delivery and return of said products under or out of warranty. Any warranty process must be previously communicated by the Customer / User to our technical services and authorized by Bem Vinhos, not being accepted any products sent to our facilities without prior consent and eventual assignment of a repair number. The warranty conditions presented by the manufacturers prevail over the information provided by Bem Vinhos, and the latter is not responsible for any errors and / or omissions in the information provided through this Service or any other means of its responsibility or the responsibility of third parties. Some manufacturers have their own warranty processes and service centres, in which case Bem Vinhoswill not be directly responsible for the process. The Client/User may contact or be redirected toCompaniesexternal to Bem Vinhosin order to obtain technical assistance under or out of warranty for products purchased from the latter.

K Intellectual Property

All content on this site, including but not limited to text, images, videos, software and other intellectual content, is the property of ::OWNER_SHORT_NAME:, its affiliates, partners, suppliers, customers or their respective owners with permission. These are protected by national and international standards of industrial and intellectual property.

L Cookies Policy

Cookies are files recorded locally by the Service on the device used by the User. These serve to facilitate navigation and use of all the functionalities of the site.

This service uses only temporary cookies, not storing any type of permanent and/or personal information on the device. These have a short duration, intended only for the maintenance of the user's session and for statistical purposes.

At no time are cookies used for storage and/or sharing of the User's personal data, nor are they shared with other entities. Only anonymous browsing data is provided to Google Analytics (which you can disable by following the instructions in https://tools.google.com/dlpage/gaoptout).

The User may at any time disable cookies in his/her Internet browser by following its instructions. In this case, some features of the service may stop working or become limited.

M - Responsibilities of Users

The User shall be liable to Bem Vinhosfor any breach or violation of these General Conditions. The User shall be responsible for the legal costs, attorneys' fees and administrative charges that Bem Vinhoshas to spend on claims or legal proceedings related to the use of the Service.

N - Termination

If the User provides false information or makes an abusive use of the Service or for any purpose contrary to the law, Bem Vinhosmay suspend the provision of the Service, without prior notice, without prejudice to the criminal liability that may be attributable to the User.

O - Applicable law and jurisdiction

Portuguese law and jurisdiction shall apply to this Agreement.

In the event of a conflict between these General Conditions of Use and the legislation currently in force, the latter shall always prevail.

A Bem Vinhosjoined the Centre for Arbitration of Consumer Conflicts of Lisbon (www.centroarbitragemlisboa.pt). In the event of a dispute, the consumer may resort to this Dispute Resolution Entity, as well as propose the use of another Entity in his area of residence. More information in www.consumidor.pt.

For other disputes arising from this Agreement that cannot be resolved by an Arbitration Center, the jurisdiction of the district of Almada is established, with express waiver of any other.
